Types of Criminal Appeals

There are different types of Criminal Appeals in NSW. These can include:

  • Local Court to District Court Appeals -  If convicted or sentenced in the Local Court, you may appeal to the District Court for a rehearing. These appeals must be filed within 28 days.

  • District Court or Supreme Court to Court of Criminal Appeal (CCA) - Appeals to higher courts may involve legal errors, miscarriages of justice, or severity of sentence. Leave to appeal is typically required.

  • Severity Appeals - You may appeal if the sentence imposed is excessive or not proportionate to the offence.

  • Conviction Appeals: If you believe you were wrongly found guilty (for example, due to legal error, fresh evidence, or an unfair trial) a conviction appeal may be available.
